How the Parties to a Car, Truck or Motorcycle Accident Claim Prove Their Cases
The evidence introduced in a motor vehicle accident lawsuit comes in many forms. Occasionally, there’s a smoking gun, so to speak—a single piece of evidence that makes or breaks a case. In most instances, though, it’s the “great weight” of all the evidence, taken as a whole, which leads a jury to a verdict.
What Are the Types of Evidence Most Commonly Presented in a Car Accident Claim?
According to data collected by Bureau of Justice Statistics (an agency of the U.S. Department of Justice), more than half of all personal injury lawsuits filed in the United States every year involve injuries sustained in motor vehicle accidents (52%). While relatively few of those cases go to trial (estimates are typically around 3 to 5 %), when they do, they will generally turn on the type and quality of evidence introduced. The common types of evidence presented in a car, truck or motorcycle accident include:
- Eyewitness testimony, either from the parties or from other drivers, bystanders or observers
- Police reports—Though there’s a general lack of uniformity in the reports prepared and submitted by law enforcement officers, they can still be compelling
- Physical evidence, including photographs of the scene, the damage to the vehicles or the injuries to the parties; the position of the vehicles in relation to each other; any skid marks or paint marks on vehicles; road conditions; traffic signals; weather factors and debris from the vehicles
- Medical records from any source, including an emergency room, urgent care facility or primary care physician. This helps identify both short-term and long-term medical needs and expenses.
- Expert witness testimony—This may take many forms, from accident reconstruction to assessment of injuries to financial projections to cover losses or expenses
