What should you know about ATV accidents?

A Texas ATV accident often involves younger people. Due to the fact that ATVs are unique vehicles, they do not require registration or driver’s licenses.

On June 12, 2023, a 12 year-old boy died as a result of an ATV accident. According to KBTX, the crash took place on private property in Burleson County, Texas in the 5000 block of County Road 249. The boy sustained life-threatening injuries. After arriving at a hospital in Caldwell, medical personnel later pronounced his death. Police were investigating the circumstances and cause of death.

Different laws apply to driving off-highway vehicles than those that apply to regular vehicles in Texas.

What are off-highway vehicles?

Off-highway vehicles include ATVs, ROVs, UTVs and Sand Rails. Certain specifications define the difference in these vehicles. For example, an all-terrain vehicle (ATV) has a seat for the rider and a seat for one passenger. It has three or more tires, is designed for off-highway use. Its design is not for lawn care or farming use. An ROV (Recreational Off-Highway Vehicle) is similar but it has a seat for the rider and one or more passengers and has four or more tires. All of these types of vehicles must having brake systems, muffler systems, head and tail lights, and a U.S. Forest Service qualified spark arrester. Unlike regular cars and trucks, you do not have to register these vehicles.

Are there safety requirements for driving Off-Highway Vehicles?

The Texas Parks & Wildlife outlines the safety requirements for driving ATVs and other off-highway vehicles. The following are some of the requirements:

  • Riders must wear protective gear, including helmets, eye protection and appropriate footwear.
  • Riders younger than 16 years old require supervision
  • The ATV should be the right size for the rider based on the rider’s age
  • No one should ride the vehicle on public roads
  • Riders should avoid paved surfaces
  • Passengers and riders should buckle up
